General Terms and Conditions (GTC) – Outdoor Kids

  1. Scope of application

These general terms and conditions (GTC) apply to participation in all services offered by Outdoor Kids (courses, training programs) in accordance with the contract concluded between Outdoor Kids and the member.

  1. Membership

Membership in Outdoor Kids entitles them to participate in the training units offered by Outdoor Kids at all locations in Germany after prior electronic registration via the website www.outdoorkids.online and in accordance with the contract concluded between the member and Outdoor Kids. The number of training units (credits) that can be booked per week varies depending on the contract concluded. Participation in the training entitles you to use all training equipment made available during training for the duration of the training and in accordance with the instructions of the Outdoor Kids trainer. Outdoor Kids provides training sessions at different locations and at different times. The offer is continuously adapted to current demand.   1. Recommendation on the member’s health

Outdoor Kids recommends its members to have their fitness for sport checked by a doctor of their choice. We do not recommend our training concept to persons with diseases of the cardiovascular system, as well as persons with damage or injuries to the spine or other orthopedic diseases / injuries, but advise that before starting the training, a recovery of sports fitness by a suitable physiotherapist and a subsequent one medical fitness examination.

  1. Workouts

Information about the available training sessions and the booking of training sessions is provided via the website www.outdoorkids.online and the email address given by the member to Outdoor Kids for this purpose. Registration: Registration for a training unit is only possible electronically via the website www.outdoorkids.online and can be made by the member no later than one (1) hour before the start of the training unit. A credit is debited from the member’s account for each training unit booked. Cancellation: A member can opt out from a training unit no later than six (6) hours before the start of the training session in return for the credit required for the training. Cancellation is not possible at a later time than six (6) hours before the start of the training unit; in this case, the credits will not be credited.

Registration via waiting list: The number of participants in a training unit is limited. As soon as the maximum number of participants for a training unit has been reached, the member can be placed on the waiting list for a training unit via the website www.outdoorkids.online. The member will then receive a message no later than one (1) hour before the start of the training session, if a place in the training session has become free and they can participate in the training session; the member is then considered registered and a credit is debited from his member account.

Non-use by the member: If the member does not use a training session for which they were registered, no credits will be credited. If no registrations are received for a training session, the training session will not take place. Outdoor Kids reserves the right to cancel, postpone or relocate training units if, for example, the weather conditions (severe weather warning from the German Weather Service), demonstrations, rallies or traditional events at the planned training location do not allow the training to be carried out properly or the members cannot travel to the training location affect unreasonably. In this case, Outdoor Kids will inform the affected members as soon as possible after becoming aware of these circumstances about the cancellation, postponement or postponement of the training session and any crediting of the credits.

  1. Conclusion of the membership contract and duration

Conclusion of contract: By submitting an order for a product (training package or other courses) via the website www.outdoorkids.online by clicking the button “Order now for a fee”, the visitor to the website places a legally binding order. The visitor to the website is bound to the order. This does not affect his / her right to cancel his / her order according to Section 12. Outdoor Kids will immediately confirm the order by e-mail to the e-mail address that the visitor to the website initially specified when ordering or with which he was previously registered on the www.outdoorkids.online website. Such an email represents a binding acceptance of the order and the contract between Outdoor Kids and the customer for membership in Outdoor Kids is concluded. Term and termination: The minimum term of membership is one (1) month. Membership can be terminated by the member or by Outdoor Kids with a notice period of one (1) month to the end of the closed initial term. The two preceding sentences only apply unless otherwise stated in the description of the ordered product (e.g. for training offers or courses on fixed dates in a certain time window or on a certain day). The member can cancel by sending an e-mail to info@outdoorkids.online or in writing to Outdoor Kids, Brückenstraße 41, Frankfurt am Main, 60594. If there is no timely termination, the contract is extended by the term of the corresponding contractual agreement. The period of notice is then again for both parties one (1) month to the end of the respective contract. The right to extraordinary termination remains unaffected. This also includes the member’s right to terminate for an important reason, e.g. due to proven permanent hindrance (e.g. through a doctor’s certificate) from using the services of Outdoor Kids. When moving to another city with a distance of more than 30 km to the nearest Outdoor Kids training location, the member is entitled to terminate the contract upon presentation of a registration confirmation from the respective city at the end of the month.

  1. Membership pause (termination)

Regardless of any existing rights to extraordinarily terminate the contract (see section 5 above), Outdoor Kids grants the member, at his request, a fee-free suspension of membership in the event of illness and for another reason not foreseeable when the contract was concluded, if such hindrance is expected to be at least 4 Lasts for weeks. A shutdown can only ever be granted for full membership months. . The contract can also be terminated without giving reasons, but in this case only for a period of four consecutive weeks. The member must request the shutdown at least 14 days before the planned shutdown by email to info@outdoorkids.online or in writing to Outdoor Kids, Brückenstraße 41, Frankfurt am Main, 60594. In the case of shutdown for a period of more than 4 weeks, evidence of the reason for the shutdown must be enclosed. Every closure requires confirmation by Outdoor Kids by email or post. The term of the contract is then extended by the period of closure; no membership fee is payable during the closure.

  1. Transfer of Membership

A transfer or sale of membership is possible after consultation and approval from Outdoor Kids to persons who were not yet a member of Outdoor Kids in the period of 12 months prior to the planned transfer. Membership must be transferred by the member, stating the desired transfer date, full name, full address and the email address of the person to whom the membership is to be transferred, to Outdoor Kids by email to info@outdoorkids.online or in writing. The transfer becomes effective at the earliest with the approval of the nominated person to transfer membership; it will be confirmed to the transferring and the new member by Outdoor Kids by email or post. Outdoor Kids charges the transferring member a one-time fee of € 60.00 for processing the transfer.

  1. Membership fee, SEPA direct debit

The contractually agreed membership fee has to be paid in advance by the member for each membership month. The membership fee is due on the first day of the month. The monthly payments owed by the member are collected by SEPA direct debit via the bank details that the member provided when concluding the contract. In the case of return debits for which the member is responsible, Outdoor Kids will pass on the resulting bank charges, which currently amount to € 3.00 per return debit. Notify changes of bank details by email toinfo@outdoorkids.online or in writing to Outdoor Kids, Brückenstraße 41, Frankfurt am Main, 60594. Only after receipt of the contractually agreed payment between the member and Outdoor Kids is the member entitled to book training units and take part in the trainings using his credits on the website www.outdoorkids.online.

  1. Prices

All prices on the website www.outdoorkids.online are gross prices including the statutory sales tax and do not include shipping costs incurred (if shown).

  1. Liability

Outdoor Kids is liable in all cases of contractual and non-contractual liability in the event of willful intent and gross negligence in accordance with the statutory provisions for damages or reimbursement of wasted expenses. Outdoor Kids is not liable for accidents caused by the participant. In other cases, Outdoor Kids is only liable – unless otherwise regulated below – in the event of a breach of a contractual obligation, the fulfillment of which enables the proper execution of the contract in the first place and which the participant can regularly rely on compliance (so-called cardinal obligation), limited to replacement the foreseeable and typical damage. In all other cases the liability of Outdoor Kids is excluded, subject to the regulation of the following sentence. Liability for damage resulting from injury to life, limb or health and under the Product Liability Act remains unaffected by the above limitations and exclusions of liability.

  1. Privacy policy

Outdoor Kids collects, stores, processes and uses personal data that Outdoor Kids receives directly from the member or via the use of the Outdoor Kids website. Outdoor Kids uses this information to design the membership and also to offer the member other offers of its own. Only the employees of Outdoor Kids and companies commissioned to execute the contract have access to the stored data. Any further transfer to third parties will not take place.

  1. Withdrawal

As a consumer, the member has a right of withdrawal. A consumer is any natural person who enters into a legal transaction for a purpose that cannot be attributed to their commercial or independent professional activity.

You have the right to withdraw from this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day the contract is concluded. In order to meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we will have given you all payments that we have received from you, including the delivery costs (with the exception of the additional costs that result from choosing a different type of delivery than the cheapest standard delivery offered by us have), to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; In no case will you be charged any fees for this repayment. If you have requested that the service should begin during the cancellation period, you have to pay us a reasonable amount, which corresponds to the portion of the services already provided up to the point in time at which you informed us of the exercise of the right of cancellation with regard to this contract compared to the total scope of the services provided in the contract.

  1. Contract changes

Outdoor Kids is entitled to unilaterally add to or change these general terms and conditions, insofar as this is necessary for legal reasons, or the changes or additions are solely for the benefit of the member. In all other cases, a unilateral change or addition to the services and these general terms and conditions is only permitted if this is reasonable for the member, taking into account the interests of Outdoor Kids. In such a case, Outdoor Kids will notify the member of any amendments or changes in writing or by email at least four weeks before they come into effect (“notification of amendments or amendments”). The member can object to such a supplement or change within a period of four weeks from receipt of the supplement or change notification in writing to Outdoor Kids, Brückenstraße 41, Frankfurt am Main, 60594 or by email to info@outdoorkids.online. If the objection is not made, the additions or changes will take effect. Outdoor Kids will specifically inform the member of the legal consequences of failing to object in the supplement or amendment notification.
